In a 339-page report and recommendation, a three-member committee on October 7, 2022, rejected over 60 charges brought against a District of Columbia attorney by the Office of Disciplinary Counsel (“ODC”). The panel found that the attorney and each of her witnesses testified credibly and persuasively and ordered only an informal admonition for several late filings, a single incorrect statement in a filing, and an inadvertent $100 overcharge over the course of a decades of probate practice.
The evidentiary hearing extended over 30 days, with a hearing transcript in excess of 5,400 pages. The committee lauded the attorney for her “exemplary” work, questioned several actions taken by ODC - using words such as “irresponsible”, “abusive”, and “outrageous” to describe ODC’s tactics - and rejected ODC’s challenge to the Firm’s “forceful” defense.
